Welcome to Axi. These Terms of Service (“Terms”) govern your access to and use of the Axilab mobile application (“App”) operated by Axilab(“we”, “us”, or “our”).

By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. Purpose of the App

Axi is a wellness application designed to analyze user-authorized sleep data and provide personalized sleep insights and educational wellness suggestions.

The App does not provide medical advice, diagnosis, or treatment.

2. Eligibility

You must be at least 16 years old to use the App. By using the App, you represent that you meet this requirement.

3. Health Data and Permissions

The App may access sleep-related data through Apple Health only with your explicit consent.

You may grant or revoke Apple Health permissions at any time through your device settings. Revoking access may limit certain features of the App.

4. AI-Generated Insights Disclaimer

The App uses artificial intelligence to generate sleep insights based on the information you provide or authorize.

If you have concerns about a medical condition or sleep disorder, please consult a qualified healthcare professional.

6. Data Privacy and Use of De-identified Data

Your use of the App is governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the App, you acknowledge that you have read and understood the Privacy Policy.

License to De-identified Data: While you retain ownership of your personal data, you grant Axi a perpetual, irrevocable, worldwide, royalty-free, and transferable license to use, reproduce, modify, and distribute any de-identified and aggregated data derived from your use of the App (including sleep and health metrics). This means that once your data is permanently stripped of personal identifiers (so it can no longer be linked to you), we may use it indefinitely for AI model training, scientific research, product improvement, and other business purposes, even after you delete your account.

All content, features, and functionality of the App, including text, software, and designs, are owned by Axilab or its licensors and are protected by applicable intellectual property laws.

You may not copy, modify, distribute, or reverse engineer any part of the App without our prior written consent.

We may suspend or terminate your access to the App at any time if you violate these Terms or misuse the App. You may stop using the App at any time.

Account Deletion: If you request to delete your account, your account will enter a 30-day grace period, after which we will delete your personally identifiable information, as detailed in our Privacy Policy.

Survival: Upon termination or deletion of your account, your right to use the App will immediately cease. However, any provisions of these Terms that by their nature should survive termination shall survive. This explicitly includes, without limitation, our perpetual right to use de-identified and aggregated data (Section 6), Intellectual Property rights (Section 7), and Limitation of Liability (Section 8).

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the updated Terms.

11. Governing Law

Except as otherwise required by applicable law, these Terms and any action related thereto shall be governed by and construed in accordance with the laws of the State of Delaware without regard to its conflict of laws provisions.
